1. Acceptance of Terms

By accessing or using CuraPlant — including our website, mobile applications, and any related services (collectively, the “Service”) — you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Service Description

• CuraPlant provides AI-powered tools for plant identification, disease detection, pest identification, weed identification, and crop advisory.
• Results are AI-generated and should be treated as guidance, not as professional agricultural or botanical advice.
• Accuracy varies by image quality, plant species, growth stage, disease progression, and lighting conditions.

3. Disclaimer of Accuracy

• CuraPlant is an AI tool — not a replacement for qualified agronomists, botanists, plant pathologists, or veterinarians.
• We do not guarantee 100% accuracy of identification or diagnosis.
• For critical crop, treatment, or financial decisions, always consult a qualified agricultural expert in your region.
• ⚠️ Mushroom identification: Do NOT use mushroom identification results to determine whether a wild mushroom is safe to eat. Misidentification of toxic mushrooms can be fatal. Our mushroom tool is for educational purposes only.

4. Acceptable Use

• Use the Service only for legitimate plant-identification and agricultural purposes.
• Do not upload images that are not plant-related, that contain personally identifying information of others, or that are illegal in your jurisdiction.
• Do not attempt to reverse-engineer, scrape, overload, or otherwise abuse the AI system.
• Do not use automated tools or bots to interact with the Service without prior written permission.

5. Intellectual Property

• CuraPlant, the CuraPlant logo, and all original content (text, design, code) are property of BWIZA TECH.
• Plant species information and disease data are aggregated for educational purposes from publicly available agricultural research.
• You retain all rights to photos you upload. You grant us a temporary, non-exclusive license solely to process them through our AI provider for the purpose of returning identification results.

6. Limitation of Liability

• BWIZA TECH is not liable for crop losses, plant deaths, financial losses, or health issues resulting from reliance on AI-generated advice.
• The Service is provided “as is” and “as available” without warranties of any kind, express or implied.
• To the maximum extent permitted by law, our aggregate liability shall not exceed the amount you paid (if any) for the Service in the past 12 months. For free-tier users, our liability is limited to USD $0.

7. Governing Law

These terms are governed by the laws of Rwanda, where BWIZA TECH is headquartered. Any disputes shall be resolved in the courts of Kigali, Rwanda. If any provision is found unenforceable, the remaining provisions continue in full effect.
